Work Permit Extension

Work Permit Extension in Canada

A work permit extension allows individuals already in Canada on a temporary work permit to continue working legally beyond the original expiry date. This extension ensures that they can remain employed without interruption.

Eligibility Requirements

  • Current Work Permit: You must hold a valid work permit that is close to expiring.
  • Job Offer: In many cases, you need a valid job offer from a Canadian employer. This depends on the type of work permit you hold.
  • Employer Compliance: Your employer must be compliant with the conditions of your current work permit and, if applicable, hold a valid Labour Market Impact Assessment (LMIA) or be exempt from it.
  • Application Timing: Apply for an extension before your current work permit expires. It’s recommended to apply at least 30 days before the expiration date.

Application Process

  1. Determine Eligibility: Ensure you meet the requirements for an extension, including having a valid job offer if needed.
  2. Gather Documents: Required documents generally include:
    • A copy of your current work permit.
    • A valid job offer letter from your employer.
    • Proof of continued employment and compliance with work permit conditions.
    • Any additional documents specified by Immigration, Refugees and Citizenship Canada (IRCC).
  3. Submit Application: Applications can be submitted online through the IRCC website or by paper. Complete the appropriate forms, including details about your current work permit and employer.
  4. Pay Fees: Pay the processing fee for the work permit extension.
  5. Await Decision: Wait for IRCC to process your application. You can remain in Canada under implied status while your application is being processed, meaning you can continue working under the same conditions as your original permit until a decision is made.

Key Points

  • Implied Status: If you apply before your current work permit expires, you can continue working under the same conditions until a decision is made.
  • Processing Times: Processing times can vary, so it’s important to apply as early as possible.
