For most employer-specific work permits, a positive Labour Market Impact Assessment (LMIA) is needed, unless the job offer is exempt from this requirement.

Types of Work Permits

  • Open Work Permit: Allows individuals to work for any employer in Canada, with exceptions. It is often granted to spouses of skilled workers, international students, or through specific programs like the International Experience Canada (IEC).
  • Employer-Specific Work Permit: Tied to a specific employer, job position, and location. It typically requires a valid job offer and, in many cases, a positive LMIA, unless the job offer is exempt from LMIA requirements.

Eligibility Requirements

  • Job Offer: A valid job offer is necessary for most work permits. For employer-specific permits, the offer must comply with Canadian labor standards and be in a NOC TEER 0, 1, 2, or 3 occupation.
  • LMIA: A positive LMIA may be required for employer-specific work permits unless the job offer is LMIA-exempt.
  • Proof of Funds: Applicants may need to demonstrate sufficient funds to support themselves and their dependents while in Canada.
  • Medical and Security Checks: Depending on the country of residence and job type, medical exams and police clearance certificates may be required.
  • Intent to Leave: Some permits require proof of intent to leave Canada upon permit expiry.

Application Process

  1. Determine the Permit Type: Identify whether an open or employer-specific work permit is needed and if an LMIA is required.
  2. Gather Documents: Collect documents such as a job offer letter, LMIA (if applicable), proof of identity, and any required medical or police clearance certificates.
  3. Submit Application: Apply online or on paper through IRCC. Complete the forms, upload documents, and pay the application fee.
  4. Processing: Processing times vary. Check the IRCC website for current timelines.
  5. Receive Decision: If approved, the permit will specify employment conditions, including employer, job role, and duration of stay.
